PIPM ALTAHOJA SOLUTIONS, S.L. (hereinafter, the “Owner”) reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website and of the content and services that may be incorporated into it. The User acknowledges and accepts that the Owner may, at any time, interrupt, deactivate and/or cancel any of these elements integrated into the Website, or access to them.

Access to the Website by the User is unrestricted and, as a general rule, free of charge, without the User having to provide any consideration in order to enjoy it, except for the cost of connection through the telecommunications network supplied by the access provider contracted by the User. Use of some of the content or services of the Website may require the User’s prior subscription or registration.

II. General terms and conditions of use

Purpose

The purpose of these General Conditions of Use (hereinafter, the “Conditions”) is to govern access to and use of the Website. For the purposes of these Conditions, the Website shall be understood as: the external appearance of the screen interfaces, both static and dynamic —that is, the navigation tree—; all the elements integrated into both the screen interfaces and the navigation tree (hereinafter, the “Content”); and all those online services or resources that it may offer to Users (hereinafter, the “Services”).

Accessing, browsing and using the Website confers the status of User, whereby all the Conditions set out herein, as well as any subsequent amendments to them, are accepted from the moment browsing begins, without prejudice to the application of the corresponding mandatory legal provisions.

The User

The User assumes responsibility for making proper use of the Website. This responsibility shall extend to using the information, content, services and data offered by the Owner in a manner that is not contrary to the provisions of these Conditions, the Law, morality or public order, and that cannot harm the rights of third parties or the proper functioning of the Website itself; and to the truthfulness and lawfulness of the information provided by the User in the forms made available by the Owner.

The User declares that they are of legal age and have sufficient legal capacity to be bound by these Conditions. Accordingly, this Website is not directed at minors. The Website is aimed primarily at Users resident in Spain; if the User resides elsewhere and decides to access it, they shall do so under their own responsibility and must ensure that such access complies with the local legislation applicable to them.

Specific conditions of each service. The services provided by the Owner (web development, AI agents, cybersecurity training and maintenance) are governed, in addition to this Legal Notice, by the specific conditions agreed with each client in the commercial proposal signed or accepted by email, which set out the scope, deliverables, timelines, price and applicable guarantee (including, where applicable, the 60-day post-delivery guarantee). In the event of any discrepancy between this Legal Notice and those specific conditions, the latter shall prevail.

III. Access and browsing: exclusion of warranties and liability

The Owner does not guarantee the continuity, availability or usefulness of the Website, or of its content or services. It will make every effort to ensure the proper functioning of the Website; however, it does not accept responsibility for, nor does it guarantee, that access to this Website will be uninterrupted or error-free. Nor does it accept responsibility for, or guarantee, that the content or software that may be accessed through this Website is error-free or will not cause damage to the User’s computer system.

Under no circumstances shall the Owner be liable for losses, damage or harm of any kind arising from access to, browsing and use of the Website, including, but not limited to, damage caused to computer systems or damage caused by the introduction of viruses. Nor shall the Owner be liable for any damage that may be caused to Users by improper use of this Website.

Artificial intelligence assistant. The Website includes an automated artificial intelligence assistant that answers the User’s questions based on the information published on this site. Its answers are provided for information and guidance only, may contain errors or be out of date, and do not constitute an offer, a quotation or a contractual commitment by the Owner. The prices, timeframes and terms of any service bind the Owner only when they are set out in a written proposal or quotation accepted by both parties. Users are asked not to enter personal data in the chat; how data is processed is described in the Privacy policy.

IV. Links policy

Users are informed that the Website makes, or may make, available to Users linking tools (such as links, banners or buttons), directories and search engines that allow access to websites owned and/or managed by third parties. Their purpose is to facilitate the search for and access to information available on the Internet, and they cannot be considered a suggestion, recommendation or invitation to visit them.

The Owner does not offer or market, either directly or through third parties, the products and/or services available on such linked sites, nor does it guarantee their technical availability, accuracy, truthfulness, validity or legality. The Owner accepts no liability for any damage or harm that may arise from the access to, use, quality or lawfulness of the content of websites not managed by the Owner that are linked from this Website.

V. Intellectual and industrial property

The Owner, either in its own right or as assignee, holds all intellectual and industrial property rights in the Website, as well as in the elements contained in it (by way of example and without limitation: images, sound, audio, video, software or texts, trademarks or logos, color combinations, structure and design, etc.). Consequently, they are works protected as intellectual property under the Spanish legal system.

All rights reserved. Pursuant to the provisions of the Spanish Intellectual Property Law (Ley de Propiedad Intelectual), the reproduction, distribution and public communication, including the making available to the public, of all or part of the content of this website for commercial purposes, on any medium and by any technical means, without the authorization of the Owner, are expressly prohibited. The User may view, print, copy and store the elements of the Website exclusively for their personal use.

VI. Legal action, applicable law and jurisdiction

The relationship between the User and PIPM ALTAHOJA SOLUTIONS, S.L. shall be governed by the regulations in force and applicable in Spanish territory. Should any dispute arise in relation to the interpretation and/or application of these Conditions, the parties shall submit their disputes to the ordinary courts, submitting to the judges and courts that have jurisdiction in accordance with the law. Where the User is a consumer, disputes shall be submitted to the Courts and Tribunals of the consumer’s place of residence.
